The Delhi Police on Tuesday cited the stringent provisions of Unlawful Activities (Prevention) Act (UAPA) to oppose the bail of accused in the case concerning larger conspiracy behind Delhi riots of 2020..Additional Solicitor General (ASG) Chetan Sharma urged the Division Bench of Justice Navin Chawla and Justice Shalinder Kaur to take a "very strict view" of the matter, considering the gravity of the case."[Article] 21 is also available to those injured and those who are no more. 21 can't be seen in isolation. This conspiracy is clinical, pathological and planned to execute by forces inimical to India. The same forces which have let themselves out on the leash in our neighboring country," Sharma added..The Court was hearing the bail petitions moved by the accused including Umar Khalid, Sharjeel Imam, Gulfisha Fatima, Khalid Saifi and others who have been in the prison for many years. Since the trial court is yet to frame the charges against them, the accused have sought bail mainly on the ground of delay in trial. .With regard to accused Umar Khalid, ASG Sharma particularly argued that he has already been denied bail by the courts once and no change of circumstances has occurred for filing another bail plea..Delhi Police also referred to the stringent bail provisions of UAPA to oppose the accused's prayer for bail."In a prima facie examination, your lordships will only see probative value that if there is an accusation and that accusation is reasonable, that is just about it," ASG Sharma said.Sharma in this regard cited Supreme Court verdicts including the 2019 judgment in the case of NIA v. Zahoor Ahmad Shah Watali and the recent Gurwinder Singh v. State of Punjab & Another.He also cited judgments holding that mere delay in trial cannot be ground for bail. Sharma also blamed the accused for causing delay in trial, citing three orders passed by the trial judge."I need not say more.
