Delhi Court seeks Police report in Jamia Millia Islamia's plea to register FIR on December 15 attack on students

A Delhi Court today directed the Delhi Police to file its Action taken Report in a plea by Jamia Millia Islamia seeking registration of FIR against Police Officials in connection with the December 15, 2019 attack on students. The University has stated that Delhi Police illegally entered into the campus without permission, unlawfully attacked innocent students with tear gas shells, lathi charge and open firing and damaged the University property..As per the order passed by Judge Rajat Goel, Metropolitan Magistrate, Saket Courts, the Action taken report shall state the following:.1. Whether any complaint has been made by the complainant in the police station.2. If yes, whether any action has been taken on the said complaint.3. Whether any investigation or inquiry has been conducted in this regard and if yes, then what is the status of the investigation/inquiry.4. If any cognizable offence is made out, whether any FIR has been registered or not..In its plea filed through Asghar Khan & Advocates, the University has stated that the students were mercilessly beaten, abuses and and derogatory comments were herald, tear gas shells were fired and lathi charge was done. .The plea reads, ."That some of the police officials without any just cause broke open the main library gate and also the doors and windows of the library building and fired tear gas shells on peaceful studying students even inside the library..That the said police officials upon realising being recorded in CCTV, switched off the lights of the reading hall, locked the doors from outside and threw tear gas bombs inside the library. It is submitted that the students in the photos and videos can be seen to be badly injured and lying on the floor in an unconscious state. It is further submitted that the injuries received by the students are grievous in nature and one of the students even lost an eye... ..police officials also broke open the Mosque of the University while the people were offering namaz and man-handled Imam of the said Mosque and mercilessly beaten the security guards of University who came to the rescue. Further, said officials also vandalised the Mosque of the university."Jamia Millia Islamia.In view of the above facts, the University has sought the registration of an FIR under Sections 268, 295, 295A, 296, 297, 298, 307, 323, 325, 338, 341, 342, 352,357, 427, 435, 447 read with sections 34 and 120-B of Indian Penal Code and under section 3 and 4 of Prevention of Damage to Public Property Act, 1984 to hold the State accountable for such illegal and unlawful acts. The plea further informs that the Chief Proctor of the University had filed a complaint on December 16, 2019 to the S.H.O Jamia Nagar for registration of an FIR and a copy of same was also sent via email to S.H.O Jamia Nagar, DCP South-east and Commissioner of Delhi Police.However, till date, no FIR has been registered in this regard..The plea informs that on December 20, 2019, the Registrar of the University wrote to the National Human Rights Commission as well the Joint Commissioner of Police, district- South East, New Delhi requesting to take immediate action on the complaint by the Chief Proctor..It is stated that meanwhile, the University fully cooperated with the police officials and in compliance of a notice under Section 91 CrPC, it also furnished 4 pen drives to the Police officials containing CCTV footage of violence..Thereafter, the University sent a complaint dated January 02, 2020 to the Deputy Commissioner of Police, Crime Branch, Delhi requesting him to register an FIR of the incident, as the earlier complaint was stated to be transferred to Crime Branch.On December 15, 2020 a reminder letter was sent by the Registrar of the University to the Commissioner of Police requesting him to direct DCP (crime)/ Jamia Nagar Police Station to register an FIR urgently..The University states that in spite of several requests and various complaints to the Police seeking registration of FIR, no action has been taken till date. Therefore, the University was left with no other alternative but to approach the Court for proper adjudication of the present matter..The matter would be heard next on March 16..Read the Order:
