In a case related to this year's Delhi riots, a Delhi Court yesterday extended the judicial custody of former JNU student Umar Khalid till November 20 (State v. Umar Khalid)..The order was passed by Judge Amitabh Rawat of the Additional Sessions Court at Karkardooma after the Delhi Police made an application for a 30-day extension of the judicial custody of Khalid..The Court also perused the case diaries submitted by Delhi Police. .Special Public Prosecutor Amit Prasad sought extension of judicial custody on the ground that investigation was still pending. .Extension of remand was opposed by counsel for Khalid, Advocate Trideep Pais on the ground that there was no application of mind. It was contended that the remand application was a "copy-paste" of the previous applications in the case. .Yesterday, Umar Khalid had stated before the Court that the Tihar jail authorities were not allowing him to step out of his cell. The Court had then directed the jail superintendent to remain present before it today. .The Jail Superintendent today responded that Khalid was taken out on a daily basis as per the jail rules. He added that in fact, yesterday, he had personally taken Khalid out of his cell. .The Court was further informed that the jail is open from sunrise till 12 noon, and then from 3 pm till sunset. .After Umar said that the situation had improved after the Court hearing yesterday, the Court directed the Jail Superintendent to ensure that such complaints are not made again. The Court also asked Khalid to cooperate with the jail authorities in view of the security issues. .Khalid was arrested by the Delhi Police on September 13 pursuant to an FIR filed under the Unlawful Activities (Prevention) Act [UAPA] in connection with the riots that broke out earlier this year..His custody was subsequently extended to October 22..It is the prosecution's case that the Delhi riots were part of a premeditated, deep-rooted conspiracy which was hatched by Khalid and his associates from various organizations..In furtherance of the conspiracy, the police has claimed, Khalid gave provocative speeches asking citizens to come out on the streets to protest and spread propaganda about minorities in India being persecuted..A detailed copy of the order is awaited.
