The Delhi High Court on Friday granted bail to five accused persons in connection with a Delhi Riots case, confirmed one of the defense counsel in the case [State v Arif, etc.]..Justice Subramonium Prasad granted the bail to Mohd Arif, Shadab Ahmad, Furkan, Suvaleen and Tabassum, confirmed defense lawyer Dinesh Tiwari. He was representing Furkan and Suvaleen in the case..Appearing before the Court, the Additional Solicitor General (ASG) SV Raju opposed the bail plea, stating that the task of identifying the accused persons through videography was a “herculean” one.“If a person is identified, it is a bonus but if he isn’t, that doesn’t mean he was not part of the mob,” Raju submitted.On the point of identification which the police carried out with the help of a face-recognition software, it was argued that given the nature of crime, and the number of people running helter-skelter, videography may not have captured an accused. “Just because they haven’t been identified, they can’t be exonerated,” Raju submitted.The court then orally stated, “People are not asking for exoneration. People are asking for bail.”The ASG responded stating that the present case attracted an offence under Section 302 (murder) of IPC and it wasn’t a simple case.“In grievous offence, particularly punishable with capital punishment, bail shouldn’t be given,” he added.Raju further contended that the entire incident was pre-planned and meeting were held one or two days prior to the incident.“Large number of persons in the mob. Not a case where police were lathicharging. Frontal attack on police who were hopelessly outnumbered.... Corroborated by witness statements that it as pre-planned.
