Delhi High Court seeks report from its joint registrar after case 'surprisingly' gets listed after vacation contrary to orders

The Delhi High Court has sought an explanation from its joint-registrar (listing) after it was informed that a case related to real estate developer Spaze Towers Pvt Ltd was listed for hearing after summer vacations despite the registry's direction to list it on June 3..Single-judge Justice Yashwant Varma expressed his surprise at the fact that the registry took cognisance of the prayer made by an unknown person for placing the matter after vacation.“In view of the above, let the Joint Registrar Listing place a report on the record of this writ petition on or before the next date fixed,” Justice Varma said in his order.The case will now be considered on July 8..Justice Varma was dealing with an application moved in already pending petitions against the Spaz Group.The application was moved by a landowner Ishan Singh through advocate Naman Joshi of chambers of Joshi & Singh.It sought investigation by the Serious Fraud Investigation Office (SFIO) and Enforcement Directorate (ED) alleging large-scale siphoning of funds by Spaze through sham companies..The High Court was told that the application was filed on May 30 and all the defects were cleared as of June 1. The registry had cleared it for listing on June 3 but the case did not come up in the cause list.When the counsel inquired with the registry and the concerned joint registrar, they were told that the listing performa had a handwritten noting stating “list the matter after vacation” and “please list the matter on July 5, 2022 as counsel is not available”.Joshi then mentioned the matter before the bench of Acting Chief Justice Vipin Sanghi.
