Sunanda Pushkar death: Delhi Police move Delhi High Court against discharge of Shashi Tharoor

More than a year after a Delhi court discharged Congress MP Shashi Tharoor of all charges in a case related to the death of his wife Sunanda Pushkar, Delhi Police has approached the Delhi High Court challenging the decision [State of NCT of Delhi v Shashi Tharoor]. .The plea was heard on Thursday by single-judge Justice Dinesh Kumar Sharma who issued notice to Tharoor on the Delhi Police's application seeking condonation of delay in filing the revision petition.The matter will be heard next on February 7, 2023..Tharoor was accused of abetting the death of Pushkar who was found dead inside a hotel room in January 2014.Though the Delhi Police initially investigated the same as a murder, with an FIR registered under Section 302 (murder) of the Indian Penal Code (IPC), it charged Tharoor under Sections 306 (abetment of suicide) and 498A (cruelty by husband)..A special court in Delhi dealing with cases against legislators had discharged Tharoor in the case in August 2021. While discharging Tharoor, the court had observed that it found no evidence to show that Tharoor had acted in a manner which provoked, encouraged or incited Pushkar to die by suicide.Special judge Geetanjali Goel had said that there was "nothing on record" to prove that Tharoor acted in order to irritate or annoy Pushkar until she reacted or for that matter “strongly persuaded or advised” her so that she died by suicide..When the plea by Delhi Police came up for hearing on Thursday, Senior Counsel Vikas Pahwa, appearing for Tharoor, highlighted the delay in filing the plea besides other issues."The petition copy has not been served on us. They have deliberately used the email id which was suspended by them. There is 15 month delay in this," it was submitted.He also contended that there were orders from the lower court as well as the High Court that the records of the case should not be shared with any outside person because of apprehension of media trial.
