The Supreme Court on Thursday expressed the view that Justice Shiva Kirti Singh should continue as Chairman of the Telecom Disputes Settlement Appellate Tribunal (TDSAT) till a fresh appointment is made to the post. .The Court also requested the Chief Justice of India to expedite the process of appointment..The Supreme Court passed this order while hearing a plea challenging Sections 12 and 13 of the Tribunal Reforms (Rationalisation and Conditions of Service) Ordinance, 2021 and Sections 184 and 186(2) of the Finance Act, 2017 as amended..During the hearing, Attorney General KK Venugopal mentioned that as per the Supreme Court order in January, Justice Singh was to continue for 3 months till a new appointment was made. However, since no appointment has been made yet, the Centre has written to Chief Justice of India NV Ramana to constitute a search and selection committee.In response to this, Justice L Nageswara Rao said,"Justice Shiva Kirti Singh is the only member and the only tribunal. We will request CJI NV Ramana to constitute the committee at the earliest. Please let it continue.".The continuance of Justice Singh will be beyond the 4-year limit prescribed by the latest Tribunal Reforms Ordinance..Justice Singh's tenure was previously extended thrice - once in January this year, in April 2020, and in July 2020.
