1. Dayanidhi Maran v. State by Deputy Superintendent of Police Central Bureau of Investigation

[Item 6 in court 2 – Special Leave Petition (Civil) 6582-6583/2015]

Bench: TS Thakur J., V. Gopala Gowda J.

The appeal filed by ex-Telecom Minister Dayanidhi Maran against a Madras High Court order rejecting anticipatory bail plea. When the matter was heard on August 12, the Supreme Court had stayed the High Court judgment cancelling Maran’s anticipatory bail and had issued notice to CBI. When the matter was last heard, the court had granted time to the parties to complete their pleadings and adjourned the matter.

Today in Court: The matter was deleted from the list.

 2. Registrar General, High Court of Judicature at Madras v. Tamil Nadu Public Service Commission

[Item 71 in court 1 – Special Leave Petition (Civil) 14842/20154]

Bench: Chief Justice HL Dattu, Amitava Roy J.

The dispute between the Madras HC and Justice CS Karnan pertaining to the selection of civil judges for the State of Tamil Nadu.

The Madras High Court had moved the Supreme Court against Justice Karnan’s judicial order and procured a stay on Justice Karnan’s order.

When the matter was last heard, it swerved to a different path as Senior Advocate KK Venugopal brought to the court’s notice the recent incidents in the Madras High Court. The Court proceeded to rebuke the Bar Associations for their inaction.

Today in Court: The matter was adjourned.

5. Anupam Tripathi  v. Union of India & Ors.

[Item 63 in court 5 – Writ Petition (Civil) 599/2015]

Bench: Dipak Misra J., Prafulla C Pant J.

Petition challenging dog culling in Kerala. The petitioner has prayed for ban on the culling in the interim till the case is finally decided.

When the case was last heard, the Supreme Court had issued notice in the petition as well as on the prayer for interim relief. Taking note of the submission by Tripathi that the case would be rendered infructuous if culling is not stopped in the interim, the court posted the case for today.

Today in Court: The Bench allowed the Animal Welfare Board to be impleaded as a party to the petition but yet again refused to grant any interim stay. After granting time to the State of Kerala for filing their reply, the matter was adjourned to November 18.

 6. JCE Consultancy v. Lee Kun Hee & Ors.

[Item 58 in court 12 – Contempt Petition (Civil)381/2015 in Criminal Appeal 304/2012]

Samsung Chairman Lee Kun Hee was ordered by the Supreme Court to appear before a Ghaziabad court in connection with a dispute over non-payment of $1.4 million to an Indian vendor. A trial court had issued a summons to Lee; with Lee unsuccessfully moving to the apex court to quash the summons.

The trial court then issued an arrest warrant. Subsequently, the Supreme Court had directed that the arrest warrant should not be executed for six weeks and had asked Lee to appear before the Court and seek bail or exemption from appearance. 

When the matter was last heard, the petitioner firm sought to withdraw the petition on the ground that a similar petition is pending before the Allahabad High Court. The court categorically refused the petitioner’s prayer and expressed doubts about the bona fides of the petitioner. It then transferred the petition pending before the Allahabad High Court to itself and said that it will hear the matter.

Today in Court: The Bench granted time of four weeks to the Petitioner for providing to the Court, a complete set of documents in the case. The matter will now be heard in December.

8. The Punjab & Haryana High Court Bar Association (Regd) v. Registrar (Recruitment), Punjab & Haryana High Court & Anr.

This case has challenged a pre-condition mandated by the Punjab & Haryana High Court for appointment of practising advocates to Haryana Superior Judicial Service. The impugned condition lays down that an applicant must be an income tax assessee for at least three assessment years preceding the application with a gross professional income of not less than Rs. 5 lakhs per annum.
