Allahabad High Court grants bail to man accused of selling sugarcane juice adulterated with beef

The Allahabad High Court recently granted bail to a man, who was arrested on the allegations of selling sugarcane juice adulterated with beef [Fuzail vs State of UP]. 

Single-judge Justice Deepak Verma granted bail to Fuzail after considering the nature of the offence, evidence and his complicity in the crime. 

"Let him be released on bail on furnishing a personal bond and teo sureties of the like amount to the satisfaction of the concerned trial court," the judge said in the order passed on January 30. 

As per the prosecution case, Fuzail, who operated sugarcane juice shop in Bareilly district, used to adulterate the juice with beef. On a complaint lodged by one of his customers, he was arrested on November 30, 2022, under Sections 323 (causing hurt), 504 (attempt to break public peace) and 295-A (outraging religious sentiments) of the Indian Penal Code (IPC).

In his defence, Fuzail argued through advocates Kaif Mohammad and Aman Kumar, that he was falsely implicated in the case with ulterior motives.

He claimed that the complainant had been to his shop and there was a dispute with regard to the payment and therefore, he was framed in this case on the basis of a concocted story. 

Fuzail highlighted the fact that there has been no forensic test of the juice from his shop and, thus, he should be granted bail.

The Court having considered the contentions granted him bail, subject to the conditions that he will not tamper with the witnesses or evidence, and will cooperate with the probe and trial.
