A group of recently enrolled advocates has approached the Delhi High Court challenging their exclusion from the electoral roll for the upcoming Bar Council of Delhi (BCD) elections

The lawyers have been excluded on the ground that they have yet to officially clear the All India Bar Examination (AIBE) as the results are still pending. The petitioners claim to have cleared the AIBE XX , based on the provisional answer key released on December 3, 2025.

It has been argued that the pendency of the AIBE results or the non-issuance of a Certificate of Practice is not a ground for disqualification under the Bar Council of India (BCI) Rules.

The plea alleges that the young lawyers are being penalised for administrative inaction, as the BCI has failed to conduct the AIBE twice a year in accordance with the AIBE Rules, 2010.

In preparation for the elections, the BCD had earlier issued a public notice requiring advocates to submit online Declarations/ Verification Forms.

In a subsequent list dated December 18, 2025, the petitioners found their names in the 'Not Verified' list, with the remark 'AIBE Not Passed.'
