Delhi High Court restrains Kuku FM from streaming 5 shows after Pocket FM alleges IP violation

Pocket FM alleged that Kuku's shows such as Shivay, Jobless Ghar Jamai, Immortal Yodha, The Legend of Amrapali and Avataar violated its intellectual property rights.

The Delhi High Court on Thursday restrained audio content platform Kuku FM (defendant) from airing new episodes of five shows over allegations of infringement of copyrighted content and trademarks by Pocket FM [Pocket FM Private Limited Vs Mebigo Labs].

In addition to this, the Court also directed Kuku FM to furnish accounts of revenues from the five shows - Shivay, Jobless Ghar Jamai, Immortal Yodha, The Legend of Amrapali and Avataar.

The interim order was passed by Justice Saurabh Banerjee in a suit filed by Pocket FM (plaintiff) seeking damages of $10 million and a decree of permanent injunction.

Pocket FM alleged that Kuku's shows violated its intellectual property rights.

According to the plaintiff, Kuku FM replicated five shows of Pocket FM in their entirety, including core themes, characters, story arcs and promotional materials. It was submitted that this constituted deliberate and systematic infringement.

Appearing for Pocket FM, Senior Advocate Amit Sibal, argued that the acts of the defendant amounted to large-scale reproduction of its original content. Pocket FM further sought appointment of a local commissioner to preserve and inspect digital evidence, contending that there was a risk of tampering or deletion by the defendant.

Pocket FM further submitted that Kuku FM had engaged in at least four earlier instances of similar conduct over the past four years, resulting in either court orders or voluntary takedowns.

In addition to copying entire series, Pocket FM also alleged that Kuku FM adopted identical or substantially similar show titles and episode names, amounting to 17 instances of overlapping show titles and 8 episode name duplications. In one case, the defendant allegedly used an identical poster for the show Shoorveer.

In response, Kuku FM, represented by advocate Saikrishna Rajagopal, argued that the shows in question had been available on its platform since June 2024.

It was submitted that Pocket FM approached the Court only in July 2025 and therefore, was not entitled to urgent interim relief. He contended that the plaintiff has not proved its case of infringement and urged the court not to grant them any interim relief.

However, the Court restrained Kuku FM from streaming new episodes of the five shows. The defendant was also directed to submit details regarding these shows.

Sibal was briefed from a team from law firm Shardul Amarchand Mangaldas.

Advocate Sidhart Chopra from Saikrishna and Associates also appeared for Kuku FM.
