Order terminating arbitration proceedings under Section 32(2)(c) Arbitration Act not an award: Delhi High Court
In view of Supreme Court decisions, the Court held that it was settled that an award constituted a final determination of a particular issue or a claim in arbitration.
The Delhi High Court has ruled that an order terminating arbitration proceedings under Section 32(2)(c) of the Arbitration & Conciliation Act, 1996 is not an award, and can be challenged under Section 14(2)of the Act (PCL Suncon v. NHAI).
